Thursday October 8, 2015 - The court has dismissed a petition by Machakos Senator, Johnstone Muthama, to block his prosecution over alleged hate remarks he made at Uhuru Park a fortnight ago.
Muthama had moved to court on Thursday to seek orders stopping Inspector General of Police, Joseph Boinnet, from arresting him after the Director of Public Prosecutions, Keriako Tobiko, recommended that he be charged. 
“Although I have certified the matter as urgent, I cannot issue the orders sought until I hear the respondents in this case. I direct the petitioner to serve the respondents and appear in court tomorrow (Friday) for further directions,” Justice Onguto ruled.
The Judge said there are safeguards in the constitution that will ensure Muthama's rights are observed.

Muthama is accused of making hate speech remarks during a CORD rally at Uhuru Park where he said President Uhuru Kenyatta and Devolution Cabinet Secretary, Miss Anne Waiguru, are lovers.
Muthama is being represented by lawyers James Orengo, John Khaminwa and Harun Ndubi.
