The Executive remains a stumbling block to the full realisation of the Constitution, the Ombudsman has said.

Commission on Administrative Justice chairman Otiende Amollo said senior government officials were resisting change.

“The top level of the Executive is still trapped in the old mindset of resisting change,” he noted.

Speaking during the second anniversary of the promulgation of the Constitution at a Nairobi hotel on Monday, Mr Amollo said voters were key in ensuring that leaders who met the constitutional threshold on integrity were elected to office.

He said there was gradual change in lower cadres of the Civil Service, with leaders who had undergone public vetting being appointed to public office.

Members of the Committee of Experts (CoE) that helped craft the Constitution attended the meeting to take stock of the progress in implementing the law.

Speakers pointed out that issues such as watering down the Integrity Bill and the Executive’s refusal to honour court decisions were signs that leaders were resistant to change.

Mr Amollo said Parliament and the Cabinet had failed to display servant leadership unlike the Judiciary which was working to make it people-friendly.

CoE member Atsango Chesoni asked the electoral commission to vet candidates to ensure tainted individuals did not creep back to power.

“We will hold you accountable should we have leaders who do not meet the integrity criteria,” she said.

Supreme Court judge Njoki Ndung’u said judicial reforms were ongoing to build confidence.

“We do not want to return to 2008 where no one had confidence in the Judiciary to handle petitions arising from the elections,” she said.
